These Terms of Service form a binding agreement between you and RHPZ HAUS, LLC. They apply when you browse this website, when you send a leasing enquiry, and when you sign a lease for a weekend cabin, a dock slip, a season pass, a kayak rack bay, a winter ice-house let or a long-stay cottage term. By using the site or signing a lease you accept these terms in full.
If you do not accept these terms, please do not send an enquiry and do not sign a lease. You may still read the public pages of the site, but no leasing relationship exists until a written lease has been accepted by both parties.
These terms should be read together with the Privacy Policy, which explains how the Company handles personal information. The Privacy Policy is available from the navigation bar at the top of every page.
RHPZ HAUS, LLC is a limited liability company registered in the United States with its address at 4712 W Bayview Dr, South Jordan - 84009-1328, United States (US). The Company leases lakeside cottages, dock space and related services from the leasing desk at that address.
The leasing desk is the only office authorised to confirm a booking, issue a lease, accept a deposit or hand over a key or a pass card. A statement made by another person, including a property host or a neighbour, does not bind the Company unless it is confirmed in writing by the desk.
The desk may be reached at leasing@rhpzhaus.lol or on +13255231350 during the business hours published on the contact page. Written notices should be sent to the South Jordan address above, marked for the attention of the leasing desk.
A lease may be signed only by a person who is at least eighteen years of age and who has the legal capacity to enter a contract. The person who signs the lease is responsible for the conduct of every member of the household named on it, and for any visitor invited to the cottage or the dock during the term.
The Company may ask for proof of identity before a lease is issued, and may decline an application where the identity cannot be verified or where a previous lease ended with an unpaid balance or an unrepaired loss. A decision to decline is confirmed in writing and includes a plain statement of the reason.
A lease is personal to the named guest. It may not be transferred to another person, sub-let, or used to host a paid event without the prior written consent of the desk.
The Company offers six lease services, each described on the services page. The services are Weekend Cabin Bookings, Dock Slip Leases, Season Pass Plans, Kayak Rack Rentals, Winter Ice-House Lets and Long-Stay Cottage Terms. A single guest may hold more than one service at a time, and the desk may combine the arrangements on one lease document.
Each service has its own season window, its own fee schedule and its own conditions, which are set out in the lease document signed by the guest. Where a service-specific condition conflicts with a general condition in these terms, the service-specific condition in the signed lease prevails for that service.
The Company may add, change or withdraw a service between seasons. A change does not affect a lease that is already running, and the desk will give written notice of any change that affects a renewal.
An enquiry does not reserve a window. A window is reserved only when the desk sends a written confirmation that names the cabin, the berth, the rack bay or the shelter, the dates of the term and the fee. The desk may hold a window for up to five working days while a lease is prepared, and the hold lapses if the lease is not signed within that period.
The desk checks the leasing ledger and the latest dock survey before a window is confirmed. A berth is not confirmed unless the depth reading for the requested dates is suitable for the craft described by the guest. A shelter is not confirmed unless the crew expects to be able to mark a safe approach for the dates concerned.
A guest who needs to change a confirmed window should write to the desk as early as possible. A change is subject to availability and may attract a rebooking fee where it is made within the notice period set out in the lease.
The fee for each service is stated in the lease document and is fixed for the term of that lease. The fee covers the use of the cottage, the berth, the rack bay or the shelter for the dates stated, together with the services that the lease describes. It does not cover the cost of a loss, damage or cleaning that goes beyond ordinary use.
A deposit is held against loss, damage or an outstanding balance. The deposit is returned after hand-back once the inventory has been checked and any deduction has been explained in writing. The desk will not keep any part of a deposit without a written explanation that refers to the relevant item of the inventory.
Payment is due on the dates stated in the lease. Where a payment is late, the desk will send a written reminder and will give a reasonable period to pay before taking any further step. A craft may be moved from a berth, or a pass card may be suspended, where a balance remains unpaid after that reminder.
A guest may cancel a booking by writing to the desk. The refund depends on how much notice is given before the start of the term. A cancellation made with thirty days or more of notice is refunded in full, apart from any card processing cost that the provider does not return. A cancellation made with less notice receives a partial refund or a credit toward a later window, as set out in the lease.
Where the Company cancels because a cottage, a berth, a rack bay or a shelter cannot be made safe, the guest receives a full refund or a replacement window of equal value, at the choice of the guest. The Company will not charge a rebooking fee in that situation.
An ice-house let that must be moved because the approach across the bay cannot be marked safely is treated as a Company cancellation. The guest is offered a later date or a full refund, and no guest is asked to choose between a fee and an unsafe route.
Keys, pass cards and rack straps are issued in person at the South Jordan office or at the dock house. Each item is entered in the ledger when it is issued and when it is returned. A guest may not copy a key or pass card, and a lost key must be reported to the desk the same day.
A guest who loses a key or a pass card may be charged the cost of replacing the lock or the card. The charge is stated in the lease and is limited to the reasonable cost of the replacement. A card that is found after a replacement has been issued should be returned to the desk.
The cottage, the berth and the rack bay must be left accessible for a maintenance inspection on the dates stated in the lease. The desk will give written notice of any inspection that requires a guest to be present, and will not enter a cottage during a term without that notice except in an emergency.
Each cottage has a written inventory that lists the furniture, the kitchen equipment, the linen and the small items supplied for the stay. The inventory is checked at hand-over and again at hand-back. A guest should report any missing or damaged item at the start of the term so that the record begins accurately.
A guest is responsible for the cottage during the term and should take reasonable care of it, keep it secure and report any fault to the desk. Ordinary wear is expected and is not charged. A loss or a damage that goes beyond ordinary wear is recorded against the deposit and explained in writing.
The cottage must be left in the condition in which it was found, apart from ordinary use. A cleaning charge may apply where a cottage is left in a condition that needs more than the usual turn-around, and the charge will be stated in the lease.
A dock slip lease assigns one berth to one craft for the term stated in the lease. The guest must supply the length, the draft, the type and the registration mark of the craft before the berth is confirmed. A change of craft must be recorded with the desk before the new craft is placed in the berth.
The guest is responsible for the lines, the fenders and the hull of the craft. The Company maintains the pier boards, the mooring rings, the ladder and the cleats at the berth, and inspects them on the schedule stated in the lease. A fault in the dock hardware should be reported to the desk the same day.
Overnight stays aboard are permitted within the term, subject to the quiet hours stated in the lease. The guest must not store fuel, paint or other hazardous material on the dock, and must not obstruct the walkway or the ladder at another berth.
A kayak rack rental assigns a numbered bay on the covered store for one kayak, a paddle pair and a small dry bag. The bay is personal to the guest, and the strap number must be kept with the bay at all times. A craft that is not registered to a current bay may be moved to the holding rack.
The guest should carry the craft to the ramp along the marked route rather than dragging it across the reed bank. The rack must be left tidy, and any strap that is worn or broken should be reported to the desk so that it can be replaced.
The Company is not responsible for a craft that is left on the rack after the lease has ended. The desk will write to the guest before the end of the term and will hold an uncollected craft for a reasonable period before arranging storage at the cost of the guest.
A winter ice-house let gives the guest the use of a small shelter for a stated session. Every let begins with a briefing on the approach route, the wind shelter and the rescue line. The guest must follow the marked route and must leave the shelter if the desk calls to say that the route has changed.
The Company may cancel or move a let where the ice on the approach is not safe. The guest must not enter the bay by an unmarked route, and must not remain on the ice after the session has ended. The shelter limit printed on the door card must not be exceeded.
A guest who finds the approach changed during a let should return to the shore and call +13255231350 before continuing. The Company keeps a written record of every route check, and that record is available to the guest on request.
A long-stay cottage term covers a full season or several seasons and is intended for a family that treats the lake as a second home. The lease sets out the term, the fee schedule, the inventory and the maintenance calendar, which lists the inspections that the crew will carry out and the dates on which the pipes are drained before frost.
The guest must not make a structural change, install a permanent mooring, sub-let the cottage or operate a business from it without the prior written consent of the Company. A request for consent should be sent to the desk in writing, and the desk will answer within a reasonable period.
Renewal is discussed in autumn, before the cottages are closed for the cold months. The desk will confirm in writing whether a renewal is offered and on what terms, and the guest will have a reasonable period to accept.
The shore is shared by several households, and the quiet character of the bay depends on the conduct of every guest. Loud music, open fires outside the marked braziers, and the use of a generator after dark are not permitted. The reed bank on the eastern shore is closed during the nesting period that the crew posts each spring.
Pets are considered on a case-by-case basis and must be declared before a lease is written. A pet must be kept under control and must not be left alone in a cottage. Waste must be cleared immediately, and a pet that disturbs another guest may be required to leave the shore.
Parking is limited to the spaces stated in the lease. A vehicle left on the shore path or blocking the ramp may be moved at the cost of the guest. Litter must be taken away at the end of a stay, and the jetty gate must be closed at dusk.
The lake is a natural body of water and is used at the risk of the guest. The Company marks the ramp, the rescue equipment and the safe approach to the ice-house shelters, but the Company cannot supervise every person on the water. Children must be supervised by an adult at all times near the shore and the dock.
The Company may close a berth, a rack bay, a shelter or a shore path when weather or water conditions make use unsafe. A closure is communicated by the desk and by a notice at the dock house, and a guest must respect it. A closure for safety reasons is not a breach of the lease by the Company.
A guest who sees a person in difficulty in the water should call the emergency services first and then the desk. Rescue equipment must not be removed from its station except for use in an emergency, and must be reported to the desk after use so that it can be replaced.
The Company is responsible for loss or damage caused by its own negligence in the maintenance of a cottage, a berth, a rack bay or a shelter. The Company is not responsible for loss or damage caused by a guest, by another visitor, by weather, by a flood, by a power failure or by an event outside the reasonable control of the Company.
The Company does not insure a guest craft, a kayak or personal property. A guest who keeps a craft on the water should hold appropriate marine insurance, and a guest who keeps property in a cottage should check that a home policy extends to a second address or should arrange separate cover.
To the extent permitted by law, the total liability of the Company under a lease is limited to the fee paid for the term concerned. Nothing in these terms limits a liability that cannot be limited by law, including a liability for death or personal injury caused by negligence.
A guest agrees to indemnify the Company against a claim, a loss or a cost that arises from the guest use of a cottage, a berth, a rack bay or a shelter, from a breach of these terms, or from the conduct of a person invited by the guest. This indemnity does not apply to a loss that is caused by the negligence of the Company.
The guest should report any incident to the desk as soon as possible so that the facts can be recorded while they are fresh. A written record made at the time helps both parties and may reduce the cost of a later dispute.
This website is provided for information about the leasing services of the Company. You may read the pages, print a copy for personal use and share a link to a public page. You may not copy the site wholesale, mirror it on another address, remove a notice of ownership, or use an automated process to harvest contact details.
The site is offered as it is. The Company works to keep the information accurate and the pages available, but does not promise that the site will be free of error or interruption. A description of a service on the site does not replace the terms of a signed lease.
Where the site includes a link to another organisation, the Company does not control that organisation and does not endorse its content. A link is provided for convenience only.
The name RHPZ HAUS, LLC, the text of this site and the design of its pages belong to the Company and are protected by law. A lease does not grant a guest a right to use the name or the design for any purpose of the guest.
A photograph, a drawing or a written note made by a guest during a stay belongs to the guest, but the guest grants the Company a limited right to use an image of the shore or a cottage for its own records where the image does not identify a person. The Company will not publish an image that shows a guest without written consent.
A request to use the name or a part of the site for a purpose outside these terms should be sent to the desk in writing.
The Company collects and uses personal information in the manner described in the Privacy Policy. In summary, information is gathered to answer an enquiry, to prepare a lease, to operate a berth, a rack bay or a shelter and to keep the records that the law requires. It is not sold or rented.
The Privacy Policy explains the rights of a guest, the retention periods that apply to each kind of record, and the way to contact the leasing desk about a privacy matter. It is available from the navigation bar and from the footer of every page.
Where a lease is signed by more than one adult, each adult should read the Privacy Policy. The desk holds contact details for the adults named on the lease and for one nominated contact who receives service messages.
The Company may suspend or end a lease where a guest fails to pay a fee after a written reminder, where a guest breaches a safety rule, where a guest causes serious damage or where a guest acts in a way that endangers another person. The desk will give written notice of the reason and, where the matter can be put right, a reasonable period to do so.
A guest may end a lease early by writing to the desk. An early end by the guest is treated as a cancellation, and the refund is calculated under the cancellation section. The guest must return the keys, the pass card and any rack strap before the deposit is closed.
Where a lease ends, the inventory is checked and the deposit is closed within a reasonable period. Any item that remains in a cottage after the end of a term is held for a period and then disposed of, after written notice to the guest.
The parties should first try to resolve a dispute by writing to the leasing desk and describing the matter plainly. The desk will review the record and reply in writing, and will propose a meeting or a call where that would help. Many matters are settled at this stage because the leasing ledger keeps a clear record of what was agreed.
If a matter is not settled through the desk, the parties may agree to mediation before a neutral mediator. Where mediation does not resolve the matter, the dispute will be decided by the courts that have jurisdiction over the Company, which is registered and operates in the United States. These terms are governed by the law of the state in which the Company is registered.
Nothing in this section prevents either party from applying to a court for an urgent order where that is necessary to protect a person or property.
If a provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force. The invalid provision is replaced by a valid provision that comes closest to the purpose of the original.
A failure by the Company to enforce a provision on one occasion is not a waiver of the right to enforce it later. A variation of these terms takes effect only when it is made in writing by the desk and accepted by the guest.
These terms and the lease document together make up the whole agreement between the parties on the leasing services. A statement made before the lease was signed does not add to the agreement unless it is written into the lease. The headings in this page are for convenience only and do not affect the meaning of a provision.
Questions about these terms, a request to vary a lease or a notice under a lease should be sent to the leasing desk. The desk is the first point of contact and will direct the matter to the person who keeps the relevant record.
